Prague’s High Court has set aside a lower court’s decision to acquit former Czech Prime Minister Andrej Babis of charges in a fraud case related to a US$2 million EU subsidy. The high court sent the case back to a lower court in Prague for a rehearing, according to information published Friday in a database of court documents. The high court had issued the decision a day earlier, but it was not immediately made public.
The case involved a farm known as Stork’s Nest, which had received EU subsidies after its ownership was transferred from the Agrofert group of about 250 companies owned by Babis to members of Babis’s family. Later, Agrofert took ownership of the farm again. The subsidy was for medium- and small-sized businesses, and Agrofert would not have been eligible for it. Agrofert later returned the subsidy.
Prague’s corporation court in January also acquitted his former colleague Jana Nagyvova, who signed the subsidy request. Babiš has pleaded innocent and has repeatedly said that the charges against him were politically motivated. It was not immediately clear when the hearing would be held again.
