Islamabad: These days Pakistan is planning to cut down the powers of the judiciary like Israel. Pakistani Prime Minister Shehbaz Sharif on Tuesday said that history will not forgive us if the Parliament does not enact a law to curtail the powers of the Chief Justice. Shehbaz Sharif’s statement came at a time when two judges of the Supreme Court of Pakistan questioned the suo motu powers of the country’s top judge. In Israel too, there has been an uproar over the law made to reduce the powers of the judiciary. After which, in view of the protests, the Netanyahu government has decided to suspend the law.

Discussion on the unlimited authority of the Supreme Court in the Parliament

Addressing a joint session of Parliament, Sharif spoke at length about the dissenting judgment of Supreme Court Justice Mansoor Ali Shah and Justice Jamal Khan Mandokhel, which allowed the Chief Justice to take suo motu cognizance and act on any issue. Criticized the unlimited power to constitute benches of choice to hear various cases. His ruling was regarding the matter of Chief Justice Umar Ata Bandial taking suo motu cognizance of elections in Punjab and Khyber Pakhtunkhwa provinces on 22 February.

Shahbaz wants control over judiciary

On the need for new laws to limit the power of the Chief Justice, Sharif said if the law was not passed, “history will not forgive us”. Meanwhile, Pakistan’s cabinet has approved a draft law on Tuesday, which seeks to curtail the discretionary powers of the Chief Justice of Pakistan, The Express Tribune newspaper reported.

Judicial reform law was also made in Israel
In Israel too, a judicial reform law was enacted to curtail the powers of the judiciary. But it was widely opposed. After the implementation of this law, the Israeli Parliament had the power to overturn the court’s decision. The benefit of this was to be more for PM Netanyahu. Due to which people said that this would weaken democracy. After protests escalated, the Israeli government came on the backfoot and had to suspend the law.
