Big decision of Patna High Court on ANM appointment

Patna High Court, while giving an important decision on Friday, said that the recruitment on 10,709 vacant posts of ANM (Auxiliary Nurse and Midwife) will be done under the same service condition rules, which were applicable at the time of publishing the advertisement of these vacancies. A single bench of Justice Mohit Kumar Shah gave this decision on Friday while accepting the petitions of 48 writ petitioners including Archana Kumari.
Appointment will be done on the basis of marks
This order of the court has provided relief to thousands of nursing candidates, whose selection process was almost completed when the changed provisions for the selection of ANM were implemented under the new service condition rules implemented by the state government on 29 September 2023. Was done. Now their appointment will be done on the basis of marks.
What argument did the petitioner give?
Petitioners’ lawyer Abhinav Srivastava had argued that the advertisement for the said vacancies was published on July 28, 2022, in which it was clearly mentioned that the conditions of Bihar Female Health Worker (ANM) Rules 2018 would be applicable for the selection.
Under the above rules, in the 100 marks competition, 60% weightage will be given to the marks obtained in ANM’s studies. The remaining marks were to be based on practical and higher education. All the petitioners participated in the selection process and the merit marks based on the above 60% marks had also been uploaded on the website of the Commission which selected all the candidates.
On September 29, a letter was issued from the Health Department informing that the above 60 percent marks will now have to be earned through a competitive examination, for which a competitive examination will be taken. On behalf of the petitioner, the court was shown the decision given by the constitutional bench of the Supreme Court and said that the rules of the game are not changed in the middle of the game. This is not only arbitrariness but also against the Constitution. The High Court gave this order while accepting the argument given by the petitioner.
