New Delhi : Do you have an LMV (Light Motor Vehicle) license and drive light transport and goods carriage vehicles? By doing this, the traffic police issues you a challan and instructs you to get a business license? In such a situation your problems would increase. Meanwhile, a big question also arises whether people who have LMV license can drive light goods vehicles or not? To know the answer to this question, we will also have to know the orders of the Supreme Court, which have been given to the government on 13 September 2023. Earlier, on July 18, 2023, the Constitution Bench had given a verdict in the case of Mukund Dewangan vs. Oriental Insurance Company Limited, in which important things have been said regarding driving goods vehicles on LMV license. It is very important for the drivers to know this decision of the Supreme Court also. Come, let us know what the Supreme Court said in its decision in this matter and what orders it gave to the government.
Government should take care of livelihood
Last September 13, 2023, the Supreme Court directed the government to consider the petition regarding driving of goods vehicles by people holding driving license in relation to light motor vehicles and said that it should also consider the livelihood of the people. The Supreme Court has said in its order that there may be lakhs of people across the country who are working on the basis of the decision given in the case of Mukund Dewangan vs. Oriental Insurance Company Limited. This is not a constitutional issue. This is completely legal. Therefore the government should consider this.
Road safety has to be balanced with the social objective of the law
A five-judge bench headed by Chief Justice of India DY Chandrachud told the government that road safety should be balanced with the social objective of the law. You have to see if it can cause serious challenges. We cannot decide matters of social policy together.
What is the court’s decision on Mukund Dewangan case?
The Constitution Bench of the Supreme Court consisting of three judges had given its verdict on July 18, 2023 in a case of Mukund Dewangan vs. Oriental Insurance Company Limited. In this decision, the Constitution Bench had said that there is no need to make any other license apart from the LMV driving license to drive a goods transport vehicle weighing less than 7,500 kg. If a person has an LMV driving license, he can drive a light goods vehicle. However, its weight should not exceed 7,500 kg. However, the government rules regarding issuing driving licenses for driving goods vehicles say something else. According to government rules, any person must have a heavy driving license to drive a goods transport vehicle.
