The Ministry of Commerce and Industry, Government of India has asked all e-commerce companies to remove all beverage products from the ‘Health Drinks’ category from their apps and websites. It is noteworthy that earlier this month, the Food Safety and Standards Authority of India (FSSAI) had directed e-commerce companies to ensure proper grading of food products. The National Commission for Protection of Child Rights had found in its investigation that no category like ‘health drinks’ has been defined in the Food Safety and Standards Act, 2006. As per legal provisions, ‘Energy Drinks’ are simply beverages to which some additional flavorings and flavors are added. The Ministry of Commerce and Industry has mentioned this investigation in its directive. Some time ago, a social media influencer had said in one of his posts that the amount of sugar in a particular product is so much that it cannot be considered a health drink. The company making that product sent a legal notice to the said influencer and pressured him to remove the video, but after investigation, the National Commission for Protection of Child Rights demanded that all the misleading advertisements should be removed.

It is a matter of great surprise that despite the category of so-called health drinks not being determined, companies have been selling their products on this basis for a long time. This is not only a violation of rules, but is also a crime of playing with the health of children by deceiving them. In recent times, there have been some issues where biscuit products made with harmful flour, sugar and refined oil are being sold as healthy. The problem of obesity among children has increased rapidly in our country in recent decades. A study based on facts and figures for the period from 2003 to 2023 has found that obesity among children is 8.4 percent, while the overweight figure is 12.4 percent. Various estimates suggest that if this issue is not addressed, it will continue to increase in the coming years and decades. India is facing the problem of under-nutrition and over-nutrition simultaneously. The main reason for this is that people lack proper information regarding nutrition. On top of this, if wrong products are sold in the name of improving the health of children, then the situation can become worrying.
