A statement made under section 164 of CrPC is admissible in evidence and can be used to corroborate or refute a statement made in a court of law under the Evidence Act. One victim, detailing alleged sexual assault, stalking and criminal intimidation, claimed that due to Singh’s actions, she had gone into “depression” and had “suicidal thoughts.” The wrestler said, “I said that I will die but will not go to Singh. I went into depression. Thoughts of suicide started coming in my mind… Also started thinking that if I do not meet him, he will not let me wrestle.”
The wrestler claimed that since he refused to meet Singh, his name was removed from the list of people who went to meet the Prime Minister. In a separate statement, an alleged victim alleged that she and other women used to go to meals in groups for fear of being confronted by Pehlwan Singh.
Another alleged victim of sexual harassment claimed that she could not return to the wrestling arena for two years after she refused to settle with Brij Bhushan Singh in 2009. The wrestler claimed that he was asked to meet Singh after he was selected for the ‘Senior National Championship’ in 2022, but there were some problems in his document verification.
Pehalwan, in his statement recorded under section 164 of CrPC, said, “At the behest of Brijbhushan Sharan Singh, (Vinod) Tomar changed the status of his document in the file from ‘verified’ to ‘unverified’, and ‘Netaji’ ( Singh) said, ‘I told you that I will not let you play in any tournament.’ Tomar is the suspended assistant secretary of WFI. The Delhi Metropolitan Court on Tuesday granted interim bail to him and Singh for two days.
