X cannot escape content moderation laws!

A judge in San Francisco, US, has ruled that Elon Musk-run X cannot escape a California law that calls for social media platforms to disclose their plans to control harmful and misinformation.

U.S. District Judge William Shubb has denied X’s request for a preliminary injunction against the law.

“The reporting requirement appears to impose a substantial compliance burden on social media companies,” Shub said.

The AB 587 law requires large social media companies to share details of how they moderate hate speech or content involving racism, extremism or radicalization, disinformation, harassment and foreign political interference.

In a complaint filed in September, X argued that the law violates the First Amendment right to free speech, The Verge reports.

The company said hate speech, misinformation and political interference are difficult to reliably define.

Ax also alleged that AB 587 would force social media platforms to ‘eliminate’ certain constitutionally protected content.

California Governor Gavin Newsom signed a law last year aimed at monitoring hate speech, extremism, harassment and other offensive behavior on social media platforms.

According to reports, AB 587 requires social media companies to post their terms of service online as well as submit twice-yearly reports to state attorneys general.
