The Kerala High Court has refused to stay the release of the controversial multi-lingual film ‘The Kerala Story’, saying overall the film’s trailer does not contain any objectionable content against any particular community. Justice N. Nagaresh and Justice Sophie Thomas noted that the makers have argued that they did not intend to release a “provocative teaser”. There is a statement in this teaser, which states that “32,000 women” from Kerala were converted and joined terrorist organizations.

Refusal to stay the release of The Kerala Story

Justice Nagaresh read out the order and said that on going through the trailer of the film “we find that the trailer by and large does not contain anything objectionable towards any particular community”. The court noted that the Central Board of Film Certification (CBFC) had seen the film. and found it fit for public display.

Disclaimer is present in the film

The Kerala High Court also said that the makers have published a ‘disclaimer’ along with the film that the film is fictional and is a dramatization of events and the film does not vouch for or confirm the facts of historical events. The court said, “In view of the disclaimer, we cannot issue any interim order restraining the producers from exhibiting the film.” In view of the above and considering the statement made by the producer that it was not the intention of the producer to release the provocative teaser on his social media handle, no further necessary orders are required to be passed in respect of this petition at this juncture .”

Request for suspension including cancellation of certificate

The High Court was hearing those petitions. In which a stay was requested by the CBFC including cancellation of the certificate given to the film for public exhibition. The petitions have argued that the film “creates a wrong impression” and that certain facts have “insulted” the people of Kerala. The petitions have requested to ban the release of the film.

‘The Kerala Story’ starring Adah Sharma hit the theaters on Friday. The story of the film is based on the “search” for “about 32,000 women” who have reportedly gone missing from Kerala.
