Supreme Court refuses to hear petitions on ban on ‘The Kerala Story’, said- first go to High Court

On Wednesday, a bench headed by the country’s Chief Justice DY Chandrachud dismissed the petitions related to the film. The court said that if the petitioners want, they can demand a hearing in the Kerala High Court before the film’s release date of May 5. In the court, Advocate Vrinda Grover, referring to the petition filed before Chief Justice DY Chandrachud, said that this petition filed by Jamiat Ulema-e-Hind, an organization of Islamic clerics, should be listed for urgent hearing. The lawyer said that the film is releasing on May 5, so the hearing should start from Thursday itself. On this, Advocate Nizam Pasha said that another petitioner named Kurban Ali has demanded a ban on the film. Pasha said that the film’s disclaimer was sought to be amended, stating that it is completely fictional.

After listening to the lawyers, CJI DY Chandrachud declined to entertain the petitions saying that a similar petition is already being heard in the Kerala High Court. When Advocate Grover pointed out that the High Court has fixed May 5 for hearing the matter, the court said that the petitioners can seek an earlier hearing from the bench if they so desire. On the other hand, senior advocate Harish Salve, appearing for the filmmakers, said that they do not agree at all to change the disclaimer.
‘The film tried to defame the entire community’
Advocate Grover said in the court, ‘The opening shot of the film says that this film is based on true events. It is promoted as a true story. Whereas this film defames the entire community. This cannot be accepted in any form. The film is releasing pan India. Advocate Nizam Pasha, who was present in the court on behalf of Jamiat, made it clear that in his petition, he is seeking to stop the release of the film. Not just talking about change in its disclaimer.
Censor Board gave A certificate with 10 cuts
On the other hand, there is a ruckus about the film in the political department as well. Kerala Chief Minister Pinarayi Vijayan, the state’s ruling party CPI(M) and the opposition Congress have opposed the film, saying it incites communal hatred. Tried to show the state negative and the claims made in it are false. However, the Censor Board has also fired scissors on the film. The film has been given an A certificate with 10 cuts.
