Surrogacy New Rules: If you are hopeful then you will definitely see a ray of hope. Yes…after a decision by the Central Government, many people have become happy. In fact, new hope has arisen for couples who are dreaming of becoming parents through surrogacy. The Center has amended the Surrogacy (Regulation) Rules, 2022. Under this, a woman will be able to fulfill her dream of becoming a mother even after divorce or death of her husband. The central government has made arrangements for this.
In general, a couple undergoing surrogacy must have both gametes from the intending couple. But as per what is stated in the Surrogacy (Regulation) Amendment Rules, 2024, notified by the government, the Center has again amended the surrogacy rules, allowing the use of donor eggs in case of medical condition of the ‘intending couple’. Or sperm may be allowed. Notification has been issued in this regard.
Surrogacy rules: What was said in the notification
If we look at the notification, it says that if the District Medical Board certifies that either spouse of the intending couple is suffering from a medical condition that requires the use of donor gametes, then the donor gametes can be used. By doing this, surrogacy is allowed. Let us tell you that last year the Supreme Court had allowed a woman suffering from Mayer-Rokitansky-Küster-Hauser (MRKH) syndrome (a rare congenital disorder) to undergo surrogacy with donor eggs.
welcome the government’s decision
Health experts have welcomed this decision of the government. This is because many women undergoing surrogacy pregnancy may be older and the number and quality of eggs decline with age. However, very few people need surrogacy. This is only for those people who have uterus problems. IVF experts have said that this is a very positive decision.
Surrogacy rules: What for widow or divorcee?
A single woman (widow or divorced) undergoing surrogacy will have to use her own eggs and donor sperm to avail the benefits of the surrogacy process.
Delhi High Court asked why single and unmarried women are excluded from the benefits of surrogacy law?
what is surrogacy pregnancy: Know what is surrogacy?
In simple words, carrying your child in the womb of a woman other than your wife has been termed as surrogacy. Such couples who want to become parents but face difficulty in having children, adopt surrogacy. There are mainly two types of surrogacy, the first being traditional surrogacy and the second being gestational surrogacy.
What is traditional surrogacy: Talking about traditional surrogacy, the work of mixing the sperm of the donor or father with the egg of the surrogate mother is done. In this entire process, the biological mother of the child is the surrogate mother. This means that surrogacy has taken place. However, once the child is born, its official parents are the couple who have opted for surrogacy.
What is Gestational Surrogacy: Now if we talk about gestational surrogacy, in this the sperm and egg of the parents are mixed and placed in the womb of the surrogate mother. In this process, the surrogate mother only works to give birth to the child. The surrogate mother is not genetically related to the child. The woman who undergoes surrogacy is considered the mother of the child.
