Speaking at an event to mark 40 years of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Malhotra said bringing clarity in tax laws and rules would help reduce litigation.

Revenue Secretary Sanjay Malhotra on Saturday said that there are 80,000 cases pending before CESTAT. He also added that the government will set up a committee to suggest measures to reduce tax related litigation and speedy disposal of old cases. Speaking at an event to mark 40 years of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Malhotra said bringing clarity in tax laws and rules would help reduce litigation.

There will be help. He said that the pendency of cases before the tribunal has always been a challenge. Malhotra said, “What will we do in the government and we will seek support from CESTAT and CBIC is with us. We will constitute a group to discuss how to reduce the pendency of cases. Whether it is through making the law simple and clear or through training (officers)…we will look at ways in which we can reduce new litigations and clear the pendency quickly.”

He informed that CESTAT is currently running at full capacity and the vacancies of last year have been filled. However, there are still 80,000 cases pending before the tribunal. “Around 20,000 cases are registered every year. We are dealing with them, but have not been able to eliminate them.
