New Delhi. The Delhi High Court on Monday dismissed a plea challenging the notification to exchange Rs 2,000 notes without a prescription and without identity proof.
A bench of Chief Justice Satish Kumar Sharma and Justice Subramaniam Prasad dismissed the petition. The petition challenged the notification of the Reserve Bank of India (RBI) and the State Bank of India (SBI) to exchange Rs 2,000 notes without a slip and without identity proof.
Petitioner and advocate Ashwini Kumar Upadhyay said that a large amount of these notes have either reached the vault of an individual, or are “with separatists, terrorists, Maoists, drug smugglers, mining mafia and corrupt people”.
The petition stated that the said notification was arbitrary, irrational and violative of Article 14 of the Constitution. The RBI defended its notification before the High Court saying that it was not demonetisation but a statutory action.
