According to media reports, the Delhi High Court has ordered the Modi government to extend Old Pension Scheme (OPS) benefits to all Central Armed Police Forces (CAPF) personnel whose recruitment process began before January 1, 2004. A bench of Justice Suresh Kumar Kait and Justice Nina Bansal Krishna has also made it clear in the order to the Center that the benefit of the old pension scheme will also apply to all the Central Armed Police Force employees who did not approach the court.

Employees appointed before 2004 will be benefited

According to the report, the Delhi High Court has given this decision to the employees of Central Reserve Police Force (CRPF), Sashastra Seema Bal (SSB), Border Security Force (BSF), Central Industrial Security Force (CISF) and Indo-Tibetan Border Police Force (ITBP). pronounced on 82 petitions filed by The petitioners had sought extension of old pension scheme benefits to employees appointed after January 1, 2004, but applied for their posts before that date.

NPS was implemented from January 1, 2004

Ankur Chibber, counsel for the petitioners, argued that an advertisement inviting applications from eligible candidates for various posts in the Central Armed Security Forces was issued in June 2002. After the selection process, the candidates were offered appointments during the period from October 2004 to 2005. Meanwhile, by a notification on December 22, 2003, the Center had implemented the New Contributory Pension Scheme (NPS) with effect from January 1, 2004.

Recruited personnel were getting benefits till December 2003

The petitioners approached the court seeking benefits of the old pension scheme, which were denied in view of an office memorandum dated February 17, 2020. Under this the benefits of the old pension scheme were limited to only those candidates who were recruited against the vacancies arising on or before December 31, 2003 and were selected. The results were declared on or before January 1, 2004.
