Trained judicial officers and advocates will play an important role in this. The special thing is that this system is going to be implemented in Chhattisgarh High Court as well as Tehsil Courts.

Along with 40 selected advocates of the state, six ADJs have also been given residential training of 40 hours through the State Legal Services Authority on how to reach an agreement between the two parties through the Mediation Act. For this six trainers had gone from Prayagraj, Delhi and Jharkhand. Trained advocates and ADJs will be responsible for getting the case resolved under mutual agreement after discussing with both the parties. Both the parties will get a lot of relief in this arrangement which is going to start in the history of the judiciary. Injunction Cases, Family Laws, Motor Accidents, Landlord & Tenant, Civil Recovery, Commercial Disputes, Consumer Laws, Financial & Transaction, All Compoundable Offences, Section 498A IPC, 138 Negotiable Instrument Act (Cheque bounce related) matters will be resolved.

Presently 89 thousand 132 cases are pending in Chhattisgarh High Court. More than four and a half lakh cases are pending in the district courts of the state. At the same time, 59 lakh 63 thousand 848 cases are pending in the High Court across the country. These include 42 lakh 86 thousand 933 civil cases and 16 lakh 76 thousand 915 criminal cases. On the instructions of the Chhattisgarh High Court, two important campaigns are being run by the State Legal Services Authority to reduce the number of pending cases. Such accused prisoners, who are not able to fight their case, are being provided free of cost advocates. Defense Layer System has been made here. Under this, advocates have been appointed in district courts. There are more chances of success in settling cases through arbitration law. It will be beneficial for all the parties in every situation. This system of justice will also be cheap. In this, both the parties will get ample opportunity to listen to each other’s words and understand their feelings. Both the parties will have the right to decide in this. There will be no compulsion and pressure anywhere. The entire process will be free and fair.

The experiment being carried out by the Supreme Court regarding the arbitration law in Chhattisgarh is a big step and will give relief to the common man. Many times it loses its importance due to the delay in getting justice to the common man due to increasing litigations in the courts and legal complications. There is a need to speed up the judicial process in both civil and criminal cases. Arbitration law has the potential to bring positive changes in civil matters. Provided that those who have the responsibility of implementing it should work with honesty and transparency. If this experiment is successful in Chhattisgarh, then the way will be opened for the implementation of arbitration law for the whole country.
