Donald Trump could be set to testify in author E. Jean Carroll’s latest civil defamation trial in Manhattan federal court on Wednesday, following a two-day adjournment due to COVID-19 concerns. U.S. District Judge Lewis Kaplan canceled testimony on Monday after a juror felt ill and was sent home for a COVID test, and Trump attorney Alina Hubba said she should be allowed to dine with her parents. After which there was a fever, one of whom got the virus.

The lawsuit relates to Trump’s June 2019 denial of Carroll’s claim that he raped the former Elle magazine advice columnist in a dressing room at the Bergdorf Goodman department store in Manhattan in the mid-1990s. A separate jury last May ordered Trump to pay Carroll $5 million over a similar denial in October 2022.
Kaplan ruled that the first trial established that Trump defamed Carroll and sexually assaulted her. The only issue for the nine jurors in the second trial is how much money, if any, Trump should give to Carroll. Carroll, 80, is demanding at least $10 million. Before the adjournment, Hubbard said Trump was planning to testify after Carroll’s lawyers presented their case. Trump plans to be in New Hampshire on Tuesday for that state’s Republican presidential primary, where he is leading in opinion polls.
