Do not give death penalty to mentally ill people: demand of global organization of psychiatrists

Pudhari Online Desk: The World Association of Psychiatrists has demanded that the accused suffering from mental illness and intellectual disability should be given a fascicle. This decision is about to be taken at the annual meeting held in Vienna.

It is submitted that, “The accused who are suffering from mental illness, who are intellectually disabled, or who have not developed mentally, should not be given education about corporal punishment. On December 31, 2022, India has given Fashi education to 539 criminals. In 2021 itself the number would have been 490. Under Project 39A of Delhi Law University, the practice of prisoners would have been conducted in 2021. Among them, 62 percent of the criminals who received Fashichi education were found to have mental illness. In the project, interviews were conducted with 83 prisoners who were undergoing Fashichi education, out of which 9 prisoners were found to be intellectually disabled. Also, 13.8 per cent of the prisoners sentenced to death have attempted suicide before the death sentence, according to the reports given to them several times.

As of July 2023, 112 states have stopped teaching about the death penalty. Only 55 deshants were given education. What is the request?

It is submitted that the possibility of an accused being convicted of a felony is unlikely, and such an accused should be tested for mental health at every legal stage. The more severe the mental illness or intellectual disability is, the more likely he or she should be hanged.
