The U.S. Court of Appeals for the District of Columbia Circuit based its decision on a similar case that was decided earlier this month.
A group of US Capitol Police officers suing former President Donald Trump over his role in the insurrection at the US Capitol on January 6, 2021, has won a legal victory. A federal appeals court ruled that his trial can proceed, rejecting Trump’s claim that he has blanket immunity from civil lawsuits. In the lawsuit, Trump has been accused of inciting the violent mob. As a result, the Capitol was attacked and officers were injured. The U.S. Court of Appeals for the District of Columbia Circuit based its decision on a similar case that was decided earlier this month.
Two Capitol Police officers and a group of House Democrats also sued Trump on January 6 over his alleged conduct. DC. The Circuit upheld a lower court’s ruling that Trump was not protected from civil liability because his alleged actions were not part of it. A three-judge panel in the latest case said the two cases are indistinguishable and Trump’s immunity argument fails.
The judges cited previous case law in their opinion, writing that even if President Trump’s actions involve speech on matters of public concern, there is no inherent connection to the essential distinction between official and unofficial acts.
