The Supreme Court of Pakistan on Saturday said that violation of the party constitution has been proved during the election of the chairman of jailed former Prime Minister Imran Khan’s party ‘PTI’. Chief Justice Qazi Faiz Isa said, “The constitution of Pakistan Tehreek-e-Insaf (PTI) says that the chairman will be elected at an interval of every two years, while the other (members) will be elected every three years. Violation of the party constitution is proved to this extent.” Justice Isa, who was leading a three-member bench, was hearing the Election Commission’s petition seeking permission to change PTI’s election symbol, Dawn.com reported. The Election Commission will allot election symbols to political parties on Saturday ahead of the February 8 general elections, Dawn reported. Earlier on Friday, in a blow to PTI, the Chief Justice ruled that the High Court order restoring the election symbol bat was prima facie flawed. The commission had on Thursday moved the top court against the decision of the Peshawar High Court (PHC), which had set aside its decision to declare organizational elections in Khan’s party unconstitutional and canceled the cricket bat election symbol.
On December 22, the Election Commission had barred PTI from keeping the bat as its election symbol for the upcoming February 8 elections, citing irregularities in its internal elections. Following the commission’s decision to cancel their symbol, PTI challenged it in the PHC, where a single-member bench granted temporary relief and reinstated the symbol and sent the case to a larger bench for hearing on January 9. . In a dramatic development, the PHC reversed its earlier decision and upheld the ECP order.
