Islamabad : Pakistan has sent its reply to India on the notice seeking amendment to the Indus Waters Treaty (IWT) 1960. India issued a notice to Pakistan on January 25 to amend the treaty, two days before the Court of Arbitration hearing in The Hague on January 27-28. India had sent this notice under Article 12 of the treaty. According to Pakistani media, sources in the Attorney General’s office said that Pakistan sent its response in the words of ‘well planned’ and ‘careful’. Pakistan says it is ready to listen to New Delhi’s concerns regarding the treaty at the level of the Permanent Commission for Indus Waters (PCIW).

According to Pakistani news website The News, the officials said that Pakistan is ready to listen to India’s concerns regarding the treaty at the level of the Permanent Commission for Indus Waters. He said that Pakistan is a low-lying country while India is a high-lying country and a low-lying country cannot violate the provisions of the Indus Waters Treaty or create any physical obstruction. Officials said a decision on negotiating changes to the treaty would be taken only after listening to India’s concerns.

India had sent notice

Pak officials said that under Article 12 of the treaty, the existing treaty would continue until the parties to the dispute, India and Pakistan, changed the agreement bilaterally. India had in January issued a notice to Pakistan under Article XII(3) of the treaty to amend the Indus Waters Treaty of 1960. Actually Pakistan has violated Article IX of the treaty. India was requesting to refer the matter to an expert. But Pakistan kept refusing to discuss.

What is Indus Water Treaty?

Pakistan did not discuss this in any of the five meetings of the Permanent Indus Commission between 2017 and 2022. Eventually India was forced to send a notice. On 19 September 1960, India and Pakistan signed the Indus Water Treaty. Under the treaty, the waters of the Sutlej, Beas and Ravi rivers fall in India’s share and the Indus, Jhelum and Chenab rivers in Pakistan’s share. Under the agreement, water commissioners of India and Pakistan meet twice a year.
