Pakistan Supreme Court upheld the law reducing the powers of the Chief Justice

In a major blow to the country’s former Prime Minister Nawaz Sharif, the Supreme Court of Pakistan on Wednesday upheld the controversial law related to reducing the powers of the Chief Justice, but the aggrieved parties in the cases decided under the suo motu jurisdiction. Banned its retrospective implementation related to granting the right to appeal.
The judges upheld the law by a majority decision. The present Chief Justice also supported this law. Under this law, the Chief Justice has been debarred from constituting benches for various cases.
Under the new law, a committee of the Chief Justice and two senior judges will form benches. Sharif will reach Pakistan from Dubai on October 21. With this, Nawaz’s four-year-long “self-exile” will end.
This decision of the court has dealt a blow to his chances of appealing against his disqualification. A full bench of the court led by Chief Justice Qazi Faiz Isa reserved its verdict after completing the hearing of several petitions challenging the Supreme Court (Practice and Procedure) Act, 2023.
The court upheld the law while giving a divided verdict. The law was supported by 10 judges while five others opposed it. With this, the court rejected all the petitions against the law. However, the Court rejected the implementation of this law in old cases.
Seven judges believed it should be applied retroactively, but eight judges supported it not being applied to old cases. Sharif has been shocked by this decision of the court. Sharif was disqualified in 2017 when the court took suo motu cognizance of his case and the decision left no scope for review of his disqualification.
