According to ‘Dawn’ newspaper, during the hearing before Justice Ajaz Khan on Tuesday, the Election Commission’s lawyer said that the Commission demands a review of the decision of the Peshawar High Court.
According to the newspaper, at the very beginning Justice Khan wanted to know whether the Supreme Court had passed any order that the direction issued by a High Court applies to the entire country. The (commission’s) lawyer said, “Absolutely.” The Supreme Court has suspended the decision of the Lahore High Court regarding the returning officers.” He said that the (commission’s) decision was suspended in a unilateral decision. He said, “Secondly, the interim relief and the final application are the same.” At one time the judge asked where the petitioner was in this case, then the Commission’s lawyer said that he did not know.
Justice Khan said he cannot pass orders in the matter as it has been listed before the division bench for January 9. However, the Commission’s counsel said that all they want from the court is to withdraw the High Court order. He said that the arguments would be presented before the division bench. According to the newspaper, the court later reserved its decision. On Monday, PTI Chairman Barrister Khan had said that his party will contest the general elections even after not getting the cricket ‘bat’ as its election symbol.
