Judicial approval by the Supreme Court of India has no legal significance. Kashmiris have the right to self-determination in accordance with relevant UN resolutions. Addressing a press conference in Islamabad, Jilani said that India has no right to take a unilateral decision on the status of this disputed region against the wishes of the Kashmiri people and Pakistan. He said, Pakistan clearly rejects the decision given by the Supreme Court of India on the status of Jammu and Kashmir.

Jilani said that the dispute regarding Jammu and Kashmir has remained on the agenda of the United Nations Security Council for more than seven decades. He said, the final settlement of Jammu and Kashmir dispute has to be done as per the relevant resolutions of the United Nations Security Council and the aspirations of the Kashmiri people. He said, Pakistan does not accept the supremacy of the Indian Constitution on Jammu and Kashmir. Any process has no legal significance under the Indian Constitution. India cannot retreat from its international obligations under the cover of its country’s laws and judicial decisions.

Relations between India and Pakistan have often been tense over the Kashmir issue and cross-border terrorism from Pakistan. Relations between the two countries further deteriorated after India abrogated Article 370, when Pakistan expelled the Indian ambassador and downgraded trade relations. India has repeatedly said that Kashmir is its internal matter, and has also said that it wants normal, friendly relations with Pakistan in an environment free from terror, violence and hostility. Jilani alleged that India’s “unilateral and illegal actions” since August 5, 2019, were aimed at changing the demographic structure and political landscape of Kashmir.

On a question, he said that Pakistan would like to maintain peace on the Line of Control (LOC) after this decision. When he was asked about the danger of increasing terrorism in Kashmir, he claimed that Kashmiris never accepted Indian rule. Ultimately, he said, their reaction will be similar to that of the people of Gaza. Jilani said that there has been no change on the issue of not talking to India. He said, no talks are going on with India and no such thing is hidden from my eyes. At the same time, former Prime Minister and President of Pakistan Muslim League-Nawaz (PML-N) Shehbaz Sharif criticized the decision of India’s top court, calling it a “biased decision”.

Shahbaz, who was the Prime Minister from April 2022 to August 2023, said, India’s top court has violated international laws by giving its decision against the UN resolutions. The Supreme Court has betrayed the sacrifice of millions of Kashmiris. He said that this “biased decision” will further strengthen Kashmir’s “freedom movement”. He said that under the leadership of Nawaz Sharif, PML-N will raise its voice for the rights of Kashmiris at every level. Pakistan People’s Party Chairman and former Foreign Minister Bilawal Bhutto Zardari said that once again it has been proved that India does not follow international laws and UN resolutions.
